Amuma Living Pty Ltd – Terms and Conditions

1. General

1.1 These Terms and Conditions (“Terms”) govern the sale of goods (“Goods”) and provision of services (“Services”) by Amuma Living Pty Ltd (“Amuma Living”) to the customer (“Customer”).

1.2 By placing an order with Amuma Living, the Customer agrees to be bound by these Terms.

2. Orders and Acceptance

2.1 All orders placed by the Customer are subject to acceptance by Amuma Living.

2.2 Amuma Living reserves the right to refuse any order at its discretion.

2.3 Orders must be placed through the Amuma Living website or an authorized representative.

2.4 The Customer is responsible for ensuring the accuracy of the details provided in their order.

3. Prices and Payment

3.1 Prices for Goods and Services are as specified in the order confirmation and are inclusive of GST unless stated otherwise.

3.2 Payment terms are as specified in the invoice. Full payment is required before dispatch of the goods unless otherwise agreed in writing.

3.3 Amuma Living reserves the right to change prices without notice, except for orders already confirmed.

3.4 The Customer is responsible for any additional taxes or duties imposed in their jurisdiction.

3.5 Payment methods accepted by Amuma Living include credit card, bank transfer, and other methods as specified on the invoice.

3.6 Amuma Living may terminate this agreement and withhold the delivery of goods and/ or services in the event that any amount remains unpaid for more than 7 days after the due date.  

4. Delivery and Risk

4.1 Delivery dates are estimates only and Amuma Living is not liable for any delay in delivery.

4.2 Risk in the Goods passes to the Customer upon delivery to the specified delivery location.

4.3 The Customer must ensure that the delivery location is accessible and suitable for the delivery of the Goods.

4.4 Delivery charges are specified at the time of purchase and may vary based on the delivery location and size of the order.

5. Title

5.1 Title to the Goods remains with Amuma Living until full payment is received.

5.2 In the event that Amuma Living agrees in writing to the delivery of Goods before payment is received in full, , the Customer must store the Goods separately and in a manner that they are identifiable as Amuma Living’s property.

5.3 Amuma Living reserves the right to reclaim Goods if full payment is not received within the agreed terms.

5.4 The Customer grants an irrevocable licence to Amuma Living or its authorised representative to enter any Customer premises during normal business hours without notice to recover any Goods that the Customer has not paid for in full despite a written demand for payment being served on the Customer.

6. Inspection and Returns

6.1 The Customer must inspect the Goods upon delivery and notify Amuma Living of any defects or discrepancies within 7 days.

6.2 Returns are subject to Amuma Living’s return policy. Custom-made or personalized items are non-returnable unless defective.

6.3 Goods must be returned in their original condition and packaging with labels attached.

6.4 The Customer is responsible for the cost of returning Goods unless they are found to be defective.

7. Warranty

All warranties provided by Amuma Living are subject to any consumer guarantees the Customer has pursuant to The Australian Consumer Law.

Goods

7.1 Amuma Living warrants that the Goods will be free from defects in materials and workmanship for a period of 12 months from the date of delivery.

7.2 In the case of Goods, Amuma Living may limit its liability for breach of any consumer guarantee provided for in the Australian Consumer Law pursuant to section 64A to any one of the following remedies:

  1. Replacement of the Goods; or
  2. Supply of equivalent Goods; or
  3. Repair the Goods; or
  4. Payment of the cost to repair the Goods.


7.3 This warranty does not cover defects to Goods caused by misuse, improper installation, or modifications made by the Customer.

Services

7.4 Amuma Living warrants that the Services will be provided in a professional and workmanlike way and in accordance with the agreed specification.

7.5 If a failure of the Service does not amount to a major failure, the Customer is entitled to have the failure rectified in a reasonable time.

7.6 If a failure of the Service amounts to a major failure, the Customer is entitled to cancel the contract for the Service and obtain a refund of any unused portion, or to compensation for its reduced value.

7.7 In the case of Services, Amuma Living may limit its liability for breach of any consumer guarantee provided for in the Australian Consumer Law pursuant to section 64A to any one of the following remedies:

  1. Resupply of the services; or
  2. Payment of the cost of having the services supplied


7.8 In order to claim under any warranty, the Customer must immediately stop using the Goods or Service (where applicable), contact Amuma Living (See contact details in clause 16) and provide a written description of the alleged defect including the serial number of the Goods together with photographs and/or video of the alleged defect. The Customer must also permit Amuma Living to conduct an inspection on the Customer’s premises if necessary.

8. Limitation of Liability

8.1 To the extent permitted by The Australian Consumer Law, Amuma Living’s liability for any claim arising out of these Terms or the supply of Goods and Services will be limited to the warranties set out in clause 7.

8.2 Subject to The Australian Consumer Law, Amuma Living is not liable for any indirect, incidental, or consequential loss or damage suffered by the Customer.

8.3 The Customer agrees to indemnify Amuma Living against any claims arising from the Customer’s use or misuse of the Goods.

9. Intellectual Property

9.1 All intellectual property rights in the Goods and any related materials remain the property of Amuma Living.

9.2 The Customer must not reproduce or use any intellectual property of Amuma Living without prior written consent.

10. Privacy

10.1 Amuma Living collects and uses personal information in accordance with its Privacy Policy, which is available on the Amuma Living website.

10.2 The Customer agrees to the collection and use of personal information for the purpose of fulfilling orders and providing customer support.

11. Governing Law

11.1 These Terms are governed by the laws of the State of Victoria, Australia and the Customer agrees to submit to the jurisdiction of Victorian courts and any applicable courts of appeal.

12. Changes to Terms

12.1 Amuma Living may amend these Terms at any time by posting the amended terms on its website. The amended terms will apply to orders placed after the date of posting.

13. Force Majeure

13.1 Amuma Living will not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including international or interstate supply chain delays, natural disasters, acts of war, or labour disputes.

14. Severability

14.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

15.1 These Terms constitute the entire agreement between Amuma Living and the Customer and supersede all prior agreements, understandings, and representations.
